The two restaurants in India will entail an investment of around Rs 3 crore. The three fine-dining outlets abroad will require around Rs 20 crore ($1.5 million each). "There is huge potential for Bengali food outside the state and elsewhere across the world," said Ramani.

Though Bengali eatery chain Oh! Calcutta is present in some Indian cities, Bengali cuisine offered in London is primarily of Bangladeshi origin. Paris and the two cities in the US do not have a destination restaurant serving Bengali food.

While it will be a challenge to establish 6 Ballygunge Place as a chain abroad, the biggest hurdle was crossed when the trademark registration was granted. Sarkar, who took up the unique trademark registration case, admitted it wasn't easy to convince the IPR judges.

"To register a trademark, the first requirement is it has to be distinct. The office argued that since it was an address in a city, it was not distinctive. Moreover, they argued that the address belonged to the owner of the house in which the restaurant is located and not the promoters of the restaurant," Sarkar pointed out.

In his argument, he reasoned that names of streets and cities (Park Avenue, Monte Carlo , Casablanca) were already used as trademarks. As for the address, it definitely was unique as the brand had been developed over a period of time.

"The house is a tangible asset. The brand that has evolved since the restaurant was launched in 2003 is intangible. The owner of the house will continue to own the address. All that he cannot do is open a restaurant by the name of that address," he said.

Having bagged the registration in India, Sarkar said it would not be difficult to apply and secure the registration in the UK, France or the US.

Incidentally, there is a multiplex with two halls named London and Paris in Ballygunge Place now. Once 6 Ballygunge Place opens in the two European capitals, a Kolkata address would have travelled to these foreign shores.
