Residency issue holds resonance

The Democrats’ Tommy Schrader problem will go away – eventually.

But for now, the party apparently plans to prove its case in court, even while a local businesswoman is challenging the Allen County Election Board for throwing Schrader off the ballot.

Schrader was in Wisconsin during Indiana’s May primary when he was on the ballot for Fort Wayne City Council at large; he even voted in Wisconsin. His decision to vote in another state while running here was a deciding factor for election board members.

Part of the problem is Indiana law has a lot of language about residency. For example, this portion seems to fit Schrader’s situation:

“If a person moves to another state with the intention of remaining in the other state for an indefinite time as a place of residence, the person loses residency in Indiana, even if the person intends to return at some time.”

That supports the decision to throw him off the ballot. But there is this language as well:

“ ‘Residence’ means the place: (1) where a person has the person’s true, fixed, and permanent home and principal establishment; and (2) to which the person has, whenever absent, the intention of returning.” Schrader said he was merely vacationing in Wisconsin and planned to return to Fort Wayne all along.

Still, considering that Schrader has lived in more than one local motel since his return, he may have trouble proving he has a “true, fixed, and permanent home.”

Businesswoman Gina Burgess, says that Schrader should have never been able to vote in Wisconsin. Perhaps, but it was Schrader who made that decision. She also challenges the Election Board’s ruling on procedural grounds. But a court ruling would make the board’s decision irrelevant.

For Democrats, the sooner they can get a final ruling, the better. The case will be the subject of an initial hearing today.

Last extension?

Mayor Tom Henry gave the developers of The Harrison, the planned retail/office/residential building next to Parkview Field, until May 31 to give city officials an update on the project. After it became clear that representatives of Barry Real Estate weren’t going to make the deadline, it was extended, to June 13. That extension wasn’t announced until Tuesday, the day of the deadline.

Henry faces a real dilemma. The Atlanta-based real estate company is apparently trying to make the project happen and is still seeking financing. Tenants are on board. Starting over could set the already much-delayed project back even further. The mayor, no doubt, would like to see construction start before the November election.

Bank Robber Sentenced

Wert will spend five years in prison for holding up the Huntington Bank in Kalida on February 24th. Officials say Kemp entered the bank, passed a note to a teller, was given money and ran. He was arrested a day later in a Ft. Wayne, Indiana motel room.

Students and staff at Indian Village Elementary swarmed the cafeteria Thursday during the school’s annual yearbook signing to say goodbye to one another and to commemorate the end of school

Kids were spread out at lunch tables, on the floor or up against the wall and were busy penning autographs for one another.

Some had the $12 full-color yearbooks that featured photos of students, teachers and support staff, and others had a handmade autograph book and some students were content to use a piece of notebook paper.

“I’ve got a lot of people,” first-grader Logan Weber told a fellow student signing Logan’s yearbook.

Today is the last day for the school’s 460 students in the prekindergarten through fifth grades.

The school days leading up to today were busy with field trips and other activities.

“It’s like they still don’t want to leave school,” second-grade teacher Sandy Zachrich said.

Scholarships

Jenna Kinn, Stephanie Meyer, Leah Moughler, Alexandra Spindler, Tiffany Wyckoff and Holli Zeedyk received Community Memorial Hospital Foundation scholarships.

Danielle Meyer of New Haven and a 2010 graduate of Woodlan High School has accepted a Chancellor’s Scholarship.

•Wayne High School students Jacquelin Saraceno, Terrence Williams, Erika Baker, Paul Hayes, Noreen Henriquez, Cristi Lehman, Adam Sullivan and Abigail Thomas received the George B., Elma B. and Ruth M. Wimmer scholarship.

Recognitions

Andrew Travis won Dr. Ron Cohen’s Good Deed Contest for helping an older woman with an oxygen tank load groceries into her car.

•The Corporation for National and Community Service has named the University of Saint Francis to its 2010 President’s Higher Education Community Service Honor Roll.

•Bishop Dwenger senior Michael J. Gloudemans has been named one of more than 3,000 candidates in the 2011 Presidential Scholars Program.

Hilary Stickell has been named an Indiana University Founders scholar.

•Vantage Career Center student Michael Hoersten placed tenth in the nation in the Business Professionals of America Computer Technology Contest.

Dr.

John P. Dormans , chief of orthopedic surgery at the Children’s Hospital of Philadelphia, received Concordia High School’s distinguished alumnus award.
