No-fault law hurts caring partner | MAKE IT LAST

I am sorry to hear about your friend's situation. Unfortunately, the "no-fault" divorce law means just that. One party can dissolve the marriage even if the other one does not want the divorce.

This law was enacted in California in 1969 and it took effect January 1, 1970. New York was the 50th state to enact it, in 2010.

The family has had a terrible breakdown as a result. According to James Dobson, the number of divorces has increased by several hundred percentage points during this time period. Several states are taking another look at this "no-fault" divorce law.

It seems to penalize the responsible person in the marriage. A spouse who does not want a divorce has lost the privilege of making a decision.

A marriage contract can be broken more easily than any other legal contract.

The original intent of the law has been lost. Many argued to enact this legislation because it was believed that bitter custody battles could be avoided.

In Indiana, it is too easy to get married and too easy to get divorced. Anyone over the age of 18 can get a marriage license with no waiting period or preparation.

People wanting a driver's license take a driving test. They take classes and learn to drive. Gun purchases have a waiting period. People are encouraged to take safety classes. It would be a good idea to require a waiting period for a marriage license and offer an incentive for marriage preparation.

It would be better for your friend if the law would be changed to require both parties in the marriage to agree to a divorce.

If you feel strongly about this issue, you could talk to your state senator and representatives. You can support your friend by encouraging the couple to get help for their marriage. Mike McManus of Marriage Savers, says, "85 percent of divorces do not need to happen."
