Leaders of the religious right are demanding a hard-line conservative Supreme Court as payback for their contribution to the re-election of President George W. Bush. Liberals, meanwhile, are seeking consolation in a roll call of justices, past and present, who have demonstrated the annoying independence fostered by elevation to a job with lifetime tenure. The list includes Earl Warren, Harry Blackmun, David Souter, and Sandra Day O'Connor, whose unpredictable swing votes on abortion cases are not exactly what Ronald Reagan had in mind when he chose her for the court in 1981.The forlorn liberal hope is that Bush, who has promised to appoint only “strict constructionists,” will repeat the scenario played out when Dwight Eisenhower described his appointment of Chief Justice Warren as the “biggest damn fool mistake I ever made.” But there is no factual basis for this wishful thinking, because what Bush means by a strict constructionist -- sometimes called an “originalist” -- is not simply a judge who is a legal conservative but one who shares the president's and his core supporters' ultraconservative religious beliefs.
It is true that many justices have responded in unanticipated ways to issues that surfaced after they ascended to the high court. Warren's leadership in producing the unanimous 1954 school-desegregation decision ( Brown v. Board of Education ) and Blackmun's 1973 authorship of the majority opinion legalizing abortion ( Roe v. Wade ) are prime examples. But if a judge interprets law as a manifestation of divine will rather than human intent, he is not morally or intellectually free to “grow” in office. What if Warren had believed, as many fundamentalists did at the time, that segregation was biblically ordained by God, and that blacks were descended from the accursed “sons of Ham”?
Far-fetched? Not when you take a close look at the public statements of one of Bush's favorite Supreme Court justice, Antonin Scalia -- a Reagan appointee touted by leaders of the Christian right as the ideal replacement for the ailing 80-year-old Chief Justice William Rehnquist -- or when you scrutinize the religious convictions of the president's recent nominees for federal district and appellate judgeships.

Presence of arsenic in chickens prompts recall of poultry drug
- The U.S. Consumer Product Safety Commission (CPSC) unanimously approved (5-0) the establishment of a new federal safety rule on hand-supported hair dryers. Hand-supported hair dryers that lack an immersion protection device have been identified by CPSC as posing a substantial product hazard to consumers. The passage of this new rule provides CPSC with more authority to (1) stop shipments of violative hair dryers at U.S. ports of entry, and (2) issue product recalls of violative hair dryers. - Children behind the futon or in the ladder area of the bunk bed can get entrapped when the futon and its metal frame are lowered from the seated to the flat position. Also, the space between the last rung on the bunk bed's ladder and the futon mattress is too small, which can allow a child's body to pass through, but not the head, posing a head and neck entrapment hazard.
Arsenic found in chickens has prompted the recall of a drug given to poultry since the 1940s to aid their growth and prevent parasitic disease.
According to a Washington Post report, the drug 3-Nitro, marketed by Pfizer Inc. subsidiary, has been pulled from the market by the drug company after recently published federal reports showed the drug’s use in chickens causes arsenic to accumulate in the poultry.
Inorganic arsenic, a cancer-causing agent, was found in the livers of chickens treated with 3-Nitro. Chickens tested by the Food and Drug Administration found no traces of inorganic arsenic in chicken who were spared the drug. Regulators conducted sample testing on 100 broiler chickens for its study.
An FDA spokesperson reported last week that levels of arsenic found in the chickens were not a threat to human health but the report did prompt Pfizer to remove the drug from the market at the FDA’s request.
Regulators seek to eliminate a source of exposure to the carcinogen by recalling 3-Nitro from the market. They urge consumers not to stop eating chickens treated with the drug.
The study was prompted by a report received at the FDA showing an ability for organic arsenic, not harmful to humans, to be able to transform into inorganic arsenic, which has been linked with the development of cancer. 3-Nitro contains organic arsenic, according to WaPo.com report.
3-Nitro was approved in the 1940s to prevent the onset of coccidiosis, a parasitic disease. It also increases the weight of chickens and improves one’s pigment.
